DomiDocs Inc. (“DomiDocs,” “HomeLock,” “we,” “our,” or “us”) is committed to protecting your privacy. We publish this Privacy Policy regarding our privacy practices in connection with our content, products, and services available (“Services”) and websites so that you can understand how we collect and protect your information. This Privacy Policy is applicable to the Services available on or through the Domidocs.com website, mobile applications (a “Mobile Application”), or tools posting a link to this page (collectively referred to as the “Site”). By using the Site, you agree to this Privacy Policy and the terms and conditions set forth below. As a subsidiary of DomiDocs, all terms contained herein concerning the information obtained by DomiDocs and the use of that information  shall also expressly apply to the information obtained by HomeLock and the use of that information.

If our information practices change at some time in the future, we will post the policy changes to our Site to notify you of these changes and we will use for these new purposes only for data and information collected from the time of the policy change forward. If you are concerned about how your information is used, you should check back at our Site periodically for any changes.

 

In addition to reading this Privacy Policy, please review our Terms and Conditions, which governs your use of the Site. By accessing our Site, you agree to our Terms and Conditions and you consent to our use and collection of your information as outlined in this Privacy Policy, so please read the information below carefully.

WHAT PERSONAL INFORMATION DO WE COLLECT

We collect and maintain three types of information from users of our Site:
  •  Personal Data: We collect certain personally identifiable information (“Personal Data”) from users of our Site, including name, physical address, e-mail address, and billing information. In addition, as part of our Services, users can upload and post information, documents, videos, photos and other materials relating to residences they own, manage or operate (“User Content”). This User Content may also contain Personal Data of users and others. You are responsible for obtaining permission to upload or post any Personal Data of any third party contained in the User Content you provide to the Site
  • Anonymous Data: This is information that does not directly or indirectly identify, and cannot reasonably be used to identify, an individual user of our Site. For example, the Site may track the total number of visitors to our Site, the number of visitors to each page of our Site, IP addresses of visitors, and any linking to External Web Sites (defined below). An IP address is associated with the access point through which you enter the Internet, and is typically controlled by your Internet Service Provider (ISP) or your company.
  • Aggregate Data: This is data about groups of users that does not identify directly or indirectly any particular individual. For example, we may analyze Personal Data and Anonymous Data for trends and statistics in the aggregate, but such information will be maintained, used and disclosed in aggregate form only and it will not contain personally identifiable information. We may use such Aggregate Data to analyze trends, administer the Site, track users’ movement, and gather broad demographic information for aggregate use

PURCHASES

In order to make purchases on the Site, you will need to provide payment information, including but not limited to your credit card or debit card number, expiration date, Card Verification Value (CVV) or Card Verification Code (CVC), and billing address. We may collect and store information about such purchases, such as the items or services purchased and the amount of the payment, but we do not process or store any payment information directly. When you submit payment information to our Site, you are submitting your information to one of our third-party payment processors. If you choose to make a purchase on the Site, the purchase will be managed by our third-party purchases’ payment processor, (“Payment Processor”). To understand how our Payment Processor collects, processes and stores your payment information, please review their applicable Privacy Policy.

HOW DO WE COLLECT YOUR INFORMATION?

We collect Personal Data and Anonymous Data through various different means from users of our Site.

We collect information, including Personal Data, when users register on our Site, purchase products or services on our Site, interact with us through customer service or other communications, respond to customer surveys, enter contests or sweepstakes or other promotions, or post or upload information or material to our Site, including on documents you upload to the Site, message boards, chat rooms and other public forums and interactive areas (“Interactive Areas”).

We use “cookie” technology to enhance your experience. A cookie is a small text file that is stored on a user’s computer for record-keeping purposes. We do not link the information we store in cookies to any personally identifiable information you submit while on our Site. If you’ve registered for our Site, cookies tell us whether you’ve been to the Site before, and help identify information you’ve already viewed on the Site or information that would be of most interest to you. The cookie itself does not obtain any personal information from you or extract any information from your computer. HOW LONG WE RETAIN PERSONAL INFORMATION

We will retain your personal information for as long as you have an active account, as needed to provide you with our services, to comply with our legal, financial reporting, or compliance obligations, and to enforce this policy.

HOW DO WE USE THE INFORMATION WE COLLECT?

We use the Personal Data and other information we collect to:
  • Provide you products and Services through our Site;
  • Process transactions online and communicate with you regarding our current and future products and services;
  • Notify you of our new products and services and other developments;
  • Provide you information of the products and services of third parties with whom we have relationships;
  • Offer, administer and fulfill promotions in compliance with applicable laws, including, but not limited to, administering sweepstakes and contest promotions;
  • Improve the content, products and services offered through our Site; and
  • Track and monitor activities to ensure compliance with our Terms and Conditions and other policies.

WITH WHOM DO WE SHARE THE INFORMATION WE COLLECT?

Our policy is not to disclose your Personal Data to any third parties, except in the following circumstances:
  • We may disclose such information to third party vendors (e.g., data storage and processing facilities) that we use to assist us in storing and processing our data, conducting transactions through the Site and in managing and providing services through the Site. We endeavor to require our third-party vendors to agree to similar obligations of confidentiality to those contained in this Privacy Policy;
  • We may disclose your name, address and any User Content that you post to our Site such as in connection with your use of Services as described in the “User Content” section below or in any Interactive Areas, which may be syndicated for publication on third-party websites;
  • We may disclose such information to other third parties at your request or when you have elected to use their services through our Site. For instance, if you elect to allow us to share your information with any third party whose services are promoted or advertised on the Site, we will be permitted to do so;
  • We are not responsible for the collection of information or data associated with voluntary disclosure of your Personal Data that is posted to Interactive Areas by any party other than DomiDocs, whether this information be posted by you or anyone else. We are also not responsible for your voluntary disclosure of any information or data to third parties for example, you may elect to publicly post or display Personal Data and information about your residence in our Interactive Areas;
  • We are also not responsible for your voluntary disclosure of any information or data to third parties (we encourage you to review the privacy policies of any third party before submitting Personal Data to them);
  • We may disclose Personal Data and other information about you as we believe is reasonably necessary to comply with laws, regulations, court or administrative orders, notification or counter notification of any intellectual property infringement or other legal claims, or other governmental authority or to prevent harm to yourself or others, or to the Site; and
  • We may disclose your Personal Data to our subsidiary and affiliated companies, upon a transfer or sale to another entity of all or substantially all of our stock or assets in the line of business that this privacy policy relates, or upon any merger or other corporate reorganization; and
  • We may disclose your Personal Data at our sole discretion as we determine is necessary to meet our professional or legal obligations or to address any other urgent or imperative issue.

We may also share Aggregate Data regarding use of our Site with third parties for marketing and other purposes, but such aggregate information will not specifically identify any particular user.

ANALYTICS SERVICES

In addition to tracking technologies, we may use third-party analytics services to gather information about our Site visitors. These services may track details about your online activities over time and across different sites. These services help us to improve our Site. These services may also allow us and others to provide you with targeted advertisements or other content that you may be interested in based on your online activities. If you would like to learn more about any targeted advertisements that you may be seeing based on your online activities, and the choices that you may exercise for certain sites and advertisers, you may wish to visit the Network Advertising Initiative or the Digital Advertising Alliance.

THIRD PARTY TRACKING AND DO NOT TRACK

Third parties may use tracking technologies in connection with our Site, which may include the collection of information about your online activities over time and across third-party websites. This Privacy Policy does not apply to these third-party technologies because we may not control them and we are not responsible for them. Do Not Track is a technology that enables users to opt out of tracking by websites they do not visit. Currently, we do not monitor or take any action with respect to Do Not Track technology.

USER CONTENT

We invite you to post User Content on our Site, including your name, address, comments, pictures, videos and any other information relating to your residence that you would like to be available on our Site. If you post User Content to public portions of our Site, all of the information that you post will be available to all visitors to our Site. If you post your User Content on our Site or Services, your posting may become public and we cannot prevent such information from being used in a manner that may violate this Policy, the law, or your personal privacy. In addition, we may syndicate and transfer your User Content to third parties for publication on third-party websites.

TRANSFER OF PERSONAL INFORMATION

Your information, including personal data and information, may be transferred to and maintained on computers located outside of your state, province, country, or other governmental jurisdiction where the data protection laws may differ from those of your jurisdiction.

DomiDocs will take all necessary steps to ensure your personal information is treated securely and in accordance with this Privacy Policy and no transfer of your personal information will take place to an organization unless there are adequate controls in place including the security of your data and other personal information.

Your use of the Site and Services, as well as your submission of such information, represents your agreement to that transfer.

HOW WE PROTECT PERSONAL INFORMATION

The security of your personal information is important to us, but remember that no method of transmission over the internet, or method of electronic storage is 100% secure. We take precautions to ensure that your personal information is secure and we strive to use every acceptable mean to protect your collected data and personal information. We use a variety of security measures to help protect your personal information and to maintain data accuracy. Unauthorized use or sharing of data and information, hardware or software failure, and other factors may compromise the security of personal information. 

ADDITIONAL IMPORTANT INFORMATION

Please note that no one can prevent all property theft and fraudulent activity, or monitor all transactions and recordings effectively. DomiDocs HomeLock Property Monitoring feature includes your home, second home, rental home, or other properties where you have an ownership interest. Identified information provided and source may be different for each state. In your state, the office that maintains real estate records could also be known as a county recorder, registrar of deeds, clerk of court, or some other government affiliated agency. 

Additionally, in certain circumstances, we derive new data using the different forms of Personal Data provided to us. We will have complete ownership and rights in any of this derivative data created by us.

OUR USE OF COOKIES AND OTHER TRACKING MECHANISMS

We and our third-party service providers use cookies and other tracking mechanisms to track information about your use of our Site or Services. We may combine this information with other personal information we collect from you (and our third-party service providers may also do so on our behalf).

Currently, our systems do not recognize browser “do-not-track” requests. You may, however, disable certain tracking as discussed in this section (e.g., by disabling cookies). In addition, we are not aware of any third parties that collect personally identifiable information about an individual consumer’s online activities over time and across different Web sites when a consumer uses the Site or the Services.

Cookies. Cookies are alphanumeric identifiers that we transfer to your computer’s hard drive through your web browser for record-keeping purposes. Some cookies allow us to make it easier for you to navigate our Site and Services, while others are used to enable a faster log-in process or to allow us to track your activities at our Site and Service. There are two types of cookies: session and persistent cookies.

  • Session Cookies: Session cookies exist only during an online session. They disappear from your computer when you close your browser or turn off your computer. We use session cookies to allow our systems to uniquely identify you during a session or while you are logged into the Site. This allows us to process your online transactions and requests and verify your identity, after you have logged in, as you move through our Site.
  • Persistent Cookies: Persistent cookies remain on your computer after you have closed your browser or turned off your computer. We use persistent cookies to track aggregate and statistical information about user activity, and to display advertising both on our Site and on third-party sites.

Disabling Cookies: Most web browsers automatically accept cookies, but if you prefer, you can edit your browser options to block them in the future. The Help portion of the toolbar on most browsers will tell you how to prevent your computer from accepting new cookies, how to have the browser notify you when you receive a new cookie, or how to disable cookies altogether. Visitors to our Site who disable cookies will be able to browse certain areas of the Site, but some features may not function.

THIRD PARTY ANALYTICS

We use automated devices and applications, such as Google Analytics, to evaluate usage of our Site and, to the extent permitted, our Mobile Application. We also may use other analytic means to evaluate our Services. We use these tools to help us improve our Services, performance and user experiences. These entities may use cookies and other tracking technologies to perform their services. We do not share your Personal Data with these third parties.

MOBILE APPLICATIONS

DomiDocs may from time to time offer users the ability to download and use Mobile Applications. By downloading and/or using these Mobile Applications, you agree to any applicable Terms and Conditions of Use as well as to this Privacy Policy. You may be required to provide Personal Data in order to use the Mobile Application, including your first name, last name, property address, telephone number, email, and password. You will have the option of providing other Personal Data in connection with your use of the Mobile Application, such as your picture, your physical location, and your birthdate. If you have provided permission through your device to allow us to collect location information, DomiDocs may obtain pinpointed physical location information from technologies like GPS, Wi-Fi, or cell tower proximity. You may be able to withdraw your permission for DomiDocs to acquire pinpointed location information from your device through your device settings, although DomiDocs does not control this process.

LINKS TO THIRD PARTY SITES

The Site may provide links to other Web sites or resources over which DomiDocs does not have control (“External Web Sites”). Such links do not constitute an endorsement by DomiDocs of those External Web Sites. You acknowledge that DomiDocs is providing these links to you only as a convenience, and further agree that DomiDocs is not responsible for the content of such External Web Sites. Your use of External Web Sites is subject to the terms of use and privacy policies located on the linked to External Web Sites. We recommend that you review such policies before using such External Web Sites.

ACCESS TO YOUR INFORMATION

We provide you the ability to exercise certain controls and choices regarding our collection, use and sharing of your Personal Data, and specifically, you may:
  • correct, update and delete your registration account;
  • change your choices for subscriptions, newsletters and alerts;
  • choose whether to receive from us offers and promotions for our products and services, or products and services that we think may be of interest to you; and
  • request access to the Personal Data we hold about you and that we amend or delete it and we request third parties with whom we have shared the information do the same. Please be aware that, if you do not allow us to collect personal information from you, we may not be able to deliver certain products and services to you, and some of our services may not be able to take account of your interests and preferences. Additionally, without permission to collect personal data, some of the functionalities of the Site may not be available for your use.

WHAT CHOICES DO I HAVE REGARDING USE OF MY PERSONAL INFORMATION?

We may send periodic promotional or informational emails to you. You may opt-out of such communications by following the opt-out instructions contained in the e-mail. Please note that it may take up to 10 business days for us to process opt-out requests. If you opt-out of receiving emails about recommendations or other information we think may interest you, we may still send you e-mails about your account or any Services you have requested or received from us.

CHILDREN

The Site is intended for general audiences, and we do not knowingly seek or collect personal information from children under the age of 13. In accordance with the Child Online Privacy Protection Act, in the event that we learn that we have collected personal information from a child under age 13 without verification of parental consent, we will delete that information as quickly as possible. If you believe that we might have any personal information from or about a child without verification of parental consent, please contact us by e-mail using the subject heading “COPPA Inquiry” at [email protected] or by phone at 833-366-4362 and we will take steps to remove that information from our Site.

SECURITY

We or our technology partners may employ procedural and technological measures designed to protect the security of Personal Data that we may collect. Such measures are reasonably designed to help protect your Personal Data from loss, unauthorized access, disclosure, alteration or destruction. We may use firewalls, password protection and other security measures to help prevent unauthorized access to your Personal Data. However, you are responsible for maintaining the confidentiality and security of the login id and password for your account at the Site, and for all activities on your account using that login id and password. CALIFORNIA PRIVACY RIGHTS

Notice to California Residents: If you are a California resident, the California Consumer Privacy Act (CCPA) applies. Under the CCPA, California consumers have the right to:

  • Request that a business that collects a consumer’s personal data disclose the categories and specific pieces of personal data that a business has collected about consumers;
  • Request that a business delete any personal data about the consumer that a business has collected; and
  • Request that a business that sells a consumer’s personal data, not sell the consumer’s personal data.

EUROPEAN PRIVACY AND DATA PROTECTION RIGHTS

DomiDocs complies with the EU-U.S. Privacy Shield Framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information transferred from the European Union to the United States. DomiDocs has certified to the Department of Commerce that it adheres to the Privacy Shield Principles. If there is any conflict between the terms in this Privacy Policy and the Privacy Shield Principles, the Privacy Shield Principles shall govern. If you are from the European Economic Area (EEA), DomiDocs’s legal basis for collecting and using the personal information described in this Privacy Policy depends on the Personal Data we collect and the specific context in which we collect it.

DomiDocs may process your personal information because: 

  • We need that data to provide our Services to you;
  • You have given us permission to do so;
  • The processing is in our legitimate interests and is not overridden by your rights;
  • It is necessary for payment processing purposes; or
  • It is necessary to comply with relevant laws.

If you are a resident of the EEA, you have certain specific data protection rights. DomiDocs aims to take reasonable steps to allow you to correct, amend, delete, or limit the use of your personal information.

TRANSFER OF INFORMATION TO THE UNITED STATES

The Site is intended for use only by residents of the United States. If you are from a country outside of the United States, please be aware that the personal information you submit, including information provided through our Site, is being sent to a location in the United States. The data protection laws in the United States may differ from those of the country in which you are located, and your personal information may be subject to access requests from governments, courts, or law enforcement in the United States according to laws of the United States. By providing such personal information, you are consenting to (and represent that you have authority to consent to), the transfer of such information to the United States for the uses and purposes described in this Privacy Policy.

If you are from the European Union or the United Kingdom, upon request, free of charge, you have the right to:

  • obtain information about the purposes for which we process your personal information and the categories of personal information concerned;
